Right of Withdrawal

Introduction

Consumers have the right of withdrawal in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to self-employed professional activities:

Right of Withdrawal

You have the right to cancel this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you or a third party designated by you, other than the carrier, took possession of the last item.

To exercise your right of withdrawal, you must notify us (cluelessmade.com | ariecom UG, Provinzialstraße 64, 53127 Bonn, Germany) of your decision in writing (e.g., by letter or email). We recommend that you use our returns portal (https://cluelessmade.com/a/retourenportal) to register your return.

Further processing of the return and the return process will take place exclusively through the portal. Once you have successfully registered, we will process your return and provide you with further information on the next steps.

Consequences of Withdrawal

If you withdraw from this contract, we will refund to you all payments received from you, including delivery costs (with the exception of any additional costs resulting from your choice of a delivery method other than the least expensive standard delivery option offered by us), without undue delay and in any event no later than fourteen days from the day on which we are informed of your decision to withdraw from this contract. We will process this refund using the same payment method you used for the original transaction, unless you have expressly agreed otherwise; in no event will you incur any fees as a result of this refund. We may withhold the refund until we have received the goods back or you have provided proof of having returned the goods, whichever occurs first. Returns from non-EU countries must be properly cleared through customs.

For special offers, the purchase price will be calculated in accordance with the applicable promotional terms. In the event of a partial return, the refund amount will be adjusted accordingly. Items received for free as part of the promotion will not be refunded.
Please note that the right to a refund applies only to the amount resulting from the recalculation of the order, taking into account the promotional terms.

You must return the goods to us in their original packaging and condition without undue delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you ship the goods before the fourteen-day period has expired. You are responsible for the direct costs of returning the goods.

You are only liable for any loss in value of the goods if such loss is due to handling of the goods that is not necessary to check their quality, characteristics, and functionality.

If the delivery of the goods fails for reasons attributable to you, you shall bear the reasonable costs incurred as a result.
This also applies if the goods must be returned to our designated return address or if a new delivery is made. The costs will be calculated based solely on the actual expenses incurred and will be accounted for transparently.

Please keep proof of return until we have issued a refund or shipped a new order. This proof should include the return address, the weight of the package, and, if applicable, a tracking number. Such proof can be, for example, the postal receipt. Make sure that the shipping service provider’s employee notes this information on the postal receipt.

Please note that you cannot drop off returns in person at our return address. All returns must be sent exclusively by mail to the address listed above.

Returns made without prior notice of withdrawal or outside the withdrawal period, as well as damaged items, cannot be processed by us and will be stored for a maximum of 7 days. Within this period, we expect you to provide a return label so that the goods can be sent back to you. If no return label is provided within this period, we cannot process the return and reserve the right to dispose of the goods as we see fit after the storage period has expired or to refuse the return.

Exclusion or premature expiration of the right of withdrawal

The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for the manufacture of which the consumer’s individual selection or specification is decisive, or which are clearly tailored to the consumer’s personal needs.

The right of withdrawal expires prematurely in the case of contracts for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been broken after delivery.

The right of withdrawal does not apply to goods whose safety or hygiene is compromised by the removal of the original labels. Please note, therefore, that returned clothing can only be accepted if all labels are intact.

Use and Returns

We want to ensure that all returns are made in accordance with applicable hygiene regulations.

1) Product testing: You may only test the products in a manner that is customary in a retail store.

2) Signs of wear: Please note that items can only be returned if they show no visible signs of wear (e.g., stains, odors, severe deformation, or washing). For returns showing signs of wear, we reserve the right to claim compensation for the loss in value resulting from use (up to 100%).

General Notes

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging, including all accessories and packaging components. If necessary, use protective outer packaging. If you no longer have the original outer packaging, please ensure sufficient protection against transport damage by using suitable packaging.
2) Please do not send the goods back to us with shipping charges unpaid.
3) Please note that the aforementioned points 1–2 are not a prerequisite for the effective exercise of the right of withdrawal.

Note on exchange (volunteer service)

An exchange is a voluntary service and not a legal right. A second exchange is subject to a fee. The cancellation period begins upon receipt of the originally ordered goods and is not extended by an exchange or a replacement delivery.

Exchanges are only accepted for items that are unwashed, unworn, and in their original packaging. Any items that do not meet these criteria may be returned at your own expense following consultation, or refunded minus any loss in value and return shipping costs. To process the exchange, the items must be returned to us within 14 days of receiving the return label or approval of the request.
